01 Who We Are

Donateazy is a company based at Bengaluru, Karnataka, India. We build and operate a cloud-based donation management platform designed specifically for Indian NGOs, charitable trusts, societies, and Section 8 companies.

Our platform helps your organisation collect donations online, manage donor relationships, generate 80G receipts, track FCRA contributions, and stay compliant with Indian tax and regulatory requirements.

02 Acceptance of Terms

By creating an account, accessing, or using the Donateazy platform in any way, you agree to be bound by these Terms of Service and our Privacy Policy. These terms form a legally binding agreement between your organisation and Donateazy.

If you do not agree with any part of these terms, please do not create an account or use the platform.

03 Eligibility

To use the Donateazy platform, your organisation must be one of the following, registered in India:

A charitable trust registered under the Indian Trusts Act or a relevant state act
A society registered under the Societies Registration Act, 1860
A Section 8 company registered under the Companies Act, 2013
Any other entity registered as a non-profit or charitable organisation under Indian law

The platform is designed for organisational use. Individual persons may not use Donateazy for personal fundraising or campaigns unconnected to a registered charitable organisation.

By registering, you confirm that you are authorised to bind your organisation to these terms.

04 Your Account

You are responsible for keeping your login credentials (email address and password) secure. Do not share your credentials with anyone who is not authorised to act on behalf of your organisation.

You must provide accurate, complete, and up-to-date information when registering your organisation, including your legal name, PAN, registration type, 80G/12A certificate details, and contact information.

If your registration status changes (for example, if your 80G certificate is cancelled, not renewed, or modified), you must update your profile on the platform within 30 days of that change. Donateazy cannot be held responsible for receipts issued based on outdated registration details you have not corrected.

You are responsible for all activity that takes place under your account.

05 What We Provide

Depending on the plan you are subscribed to, the Donateazy platform may include:

Online donation collection with a secure payment link and public profile page
Donor CRM: maintain donor records, communication history, and giving patterns
Automated 80G receipt generation and delivery to donors
10BD export: generate the annual statement of donations in the format required by the Income Tax Department
FCRA contribution tracking: separate foreign and Indian donations as required under the Foreign Contribution (Regulation) Act, 2010
Campaign management: create and manage fundraising campaigns
NGO public profile: a public-facing page for your organisation
Communications tools: send WhatsApp and email messages to donors

Specific features available to your organisation depend on the plan you have selected. We reserve the right to modify, add, or remove features with reasonable notice.

06 Permitted Use

You may use the Donateazy platform solely for the purpose of managing genuine charitable donations for your registered organisation's stated charitable purposes.

If your organisation receives foreign donations, you must comply with the Foreign Contribution (Regulation) Act, 2010 (FCRA) and all rules and notifications issued under it. This includes maintaining a separate FCRA bank account, filing annual returns, and using foreign contributions only for the purposes permitted under your FCRA registration.

You must use the platform in compliance with all applicable Indian laws, including the Income Tax Act 1961, the Prevention of Money Laundering Act 2002 (PMLA), and any applicable state laws governing charitable organisations.

07 Prohibited Conduct

You may not use the Donateazy platform to:

Collect donations for purposes not stated in your organisation's registration documents
Personally enrich any individual, trustee, or director in violation of your organisation's governing documents or Indian law
Misrepresent your registration status, 80G eligibility, or FCRA status to donors or to Donateazy
Collect donations while your registration, 80G, or 12A status is suspended, cancelled, or lapsed
Reverse-engineer, decompile, copy, or create derivative works from the Donateazy platform or its software
Share your account credentials with unauthorised third parties
Use the platform to facilitate money laundering, tax evasion, or any activity that is illegal under Indian law
Upload or transmit malicious code, spam, or content that violates any third party's rights

We reserve the right to immediately suspend access to any account we reasonably believe is engaged in prohibited conduct.

08 Payment Processing

Donations made through the Donateazy platform are processed by Razorpay (Razorpay Software Private Limited). Donateazy is not a party to the transaction between the donor and your organisation. We do not hold, receive, or manage donor funds at any point.

Settlement of donations to your organisation's bank account is managed by Razorpay in accordance with their terms of service and settlement schedule. Any disputes related to payment settlement should be raised directly with Razorpay.

Donateazy may charge a platform fee for use of the service. This fee is set out in the plan you have selected and is shown clearly at the time of subscription. All platform fees are exclusive of Goods and Services Tax (GST), which will be charged at the rate applicable at the time of invoicing.

09 80G Receipts and Compliance

Donateazy generates 80G donation receipts based on the registration details you enter in your account, including your PAN, 80G certificate number, and certificate validity dates.

You are solely responsible for the accuracy of this information. It is your responsibility to ensure that your 80G and 12A registrations are valid and current, and that the details entered in the platform are correct. Donateazy does not verify your registration details with the Income Tax Department.

Donateazy is a technical facilitator. We provide tools to assist with compliance, but we do not provide legal advice, tax advice, or any assurance regarding the tax deductibility of donations made to your organisation. Donors should consult their own tax advisors.

If an incorrect receipt is issued because of inaccurate information in your account, the responsibility for rectifying that error, including any communication to donors, rests with your organisation.

10 FCRA Compliance

If your organisation holds a valid FCRA registration, you must enable the FCRA tracking feature in the Donateazy platform and correctly tag all foreign-sourced donations. This helps you maintain the separate accounting required under the FCRA.

Donateazy provides tools to help you track, categorise, and report foreign contributions. However, the complete legal and regulatory responsibility for FCRA compliance, including maintaining a separate FCRA bank account, filing annual FC-4 returns, and using foreign contributions only for permitted purposes, rests entirely with your organisation.

If your FCRA registration is surrendered, cancelled, or not renewed, you must immediately update your profile and cease accepting foreign donations through the platform.

11 Your Data

Please read our Privacy Policy for full details of how we collect, use, and protect data.

You own your donor data. Donateazy processes that data only to provide the services described in these terms and our Privacy Policy. We do not sell, trade, or use your donor data for any purpose other than providing the platform to you.

12 Intellectual Property

"Donateazy" and the Donateazy logo are trademarks of Donateazy. You may not use our name, logo, or brand without our written permission.

The Donateazy platform, including its software, design, features, and documentation, is owned by Donateazy and protected by applicable intellectual property law.

You retain full ownership of your organisational data: your donor records, campaign content, documents, and reports. We do not claim any ownership over the data you create or upload to the platform.

13 Suspension and Termination

We may suspend or terminate your account if:

You violate any part of these Terms of Service
We reasonably suspect fraudulent activity, misuse of donor funds, or misrepresentation
We are required to do so by law or a government authority
You fail to pay platform fees beyond the grace period stated in your plan

You may close your account at any time by contacting us. On closure, you will have 30 days to export your data (donor records, donation history, receipts) in standard formats (CSV and PDF). After 30 days, your data will be deleted from our active systems, subject to any retention obligations required by Indian law.

We retain records (including donation records and receipt copies) for as long as required by the Income Tax Act, FCRA, and other applicable Indian laws, typically 7 years.

14 Limitation of Liability

Donateazy provides the platform on an "as is" basis. We take reasonable care to keep it reliable and secure, but we cannot guarantee it will be uninterrupted or error-free at all times.

Our total aggregate liability to your organisation for any claim arising from your use of the platform shall not exceed the platform fees you have paid to us in the 12 months immediately before the date the claim arises.

We are not liable for:

Losses arising from inaccurate registration information, PAN details, or 80G data that you have entered
Decisions your organisation makes based on platform reports or analytics
Outages or delays caused by Razorpay or other third-party services
Loss of data due to your own actions (e.g., accidental deletion)
Indirect, consequential, or punitive damages of any kind

15 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India.

Any disputes arising from or in connection with these terms or your use of the Donateazy platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

16 Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in the platform, applicable law, or our business practices.

For significant changes, we will notify you by email at least 14 days before those changes take effect. The updated terms will also be posted on this page with a revised "Last updated" date.

If you continue to use the platform after the effective date of the revised terms, you are deemed to have accepted the changes. If you do not agree to the new terms, you should stop using the platform and close your account before the changes take effect.
